These terms cover using this website and the free tools on it. They are deliberately short. If you engage BYLDR to build something, that work is governed by a separate written proposal — not by this page.
01Agreement
BYLDR is a sole-operator web design and development studio based in Sydney, Australia, operating byldr.studio. By using this website you accept these terms. If you don't accept them, don't use the site.
02Using this site
You're welcome to browse, read, screenshot and share this site. Everything on it is provided for information — it's a studio portfolio and an enquiry channel, not a contract.
We try to keep the site up and accurate, but we don't promise it will always be available or free of errors. It can change or come down without notice.
03The free website audit
The audit tool scans a website address you provide and returns scores, findings and an indicative rebuild range. It's free and it's genuinely useful, but you should understand what it is:
- It's automated. The scores come from public page data and third-party APIs, including Google PageSpeed Insights. It is not a manual expert review, and it can be wrong or incomplete.
- Speed scores aren't always available. When a live speed test can't be run, the report says so and shows conservative estimates rather than inventing a number.
- Only scan sites you're entitled to scan. By submitting an address you confirm you own that website or have permission to test it. Don't point it at anyone else's site to snoop on them.
- Don't rely on it alone. Nothing in the report is professional advice about your business, your SEO, your accessibility obligations or your legal compliance.
We may rate-limit, restrict or withdraw the tool at any time, particularly if it's being abused.
04Quotes and estimates
Any price range shown by the audit tool, or discussed by email before a proposal, is indicative only. It's an educated estimate based on limited automated information about your current site.
No price is binding on either of us until it appears in a written proposal signed or accepted in writing. Real scope changes real numbers — that conversation happens before any work starts, not after.
05Project work
If you engage BYLDR to design or build something, the terms of that engagement are set out in a separate written proposal or agreement covering scope, price, timeline, revisions, payment terms and ownership. That document governs the work and takes precedence over this page.
Submitting an enquiry through this site doesn't create a contract, reserve time in the schedule or oblige either of us to proceed.
06Intellectual property
The design, code, copy, graphics and the BYLDR name and mark on this site belong to BYLDR. Please don't copy the site wholesale, resell it, or pass the work off as your own.
Screenshots, logos and brand elements of client and concept projects shown in the portfolio belong to their respective owners and appear here to document work BYLDR has produced.
Ownership of work produced for a client transfers as set out in that project's written agreement.
07Acceptable use
Don't do any of the following:
- Scrape, harvest or bulk-download the site or its assets
- Automate, flood or otherwise abuse the audit tool or the contact forms
- Attempt to break, probe or gain unauthorised access to the site or its serverless functions
- Submit anyone else's personal details through the forms without their knowledge
- Use the site to send anything unlawful, misleading, threatening or abusive
08Liability
The site and the free tools are provided "as is". To the maximum extent permitted by law, BYLDR isn't liable for indirect or consequential loss arising from your use of this website or reliance on anything the audit tool reports.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where liability can be limited rather than excluded, it is limited to re-supplying the relevant service or paying the cost of having it re-supplied.
09Privacy
What we collect and why is set out in the Privacy Policy. You can have your information deleted at any time — see Data deletion.
10Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction over any dispute arising from them.
11Changes
These terms can change. The current version always lives at this address, with the date it was last updated at the top. Continuing to use the site after a change means you accept the updated terms.
